CARDA Subscription Service

These Terms and Conditions form part of the Letter of Engagement between the Client (“you”, “your”) and CARDA (“we”, “us”, “our”).
1. Contact Details
You may contact us via:
- Email: people at 2earth dot net
- Postal Address: 481 Sussex Inlet Road, Sussex Inlet NSW 2540, Australia
2. Description of Services
CARDA is a subscription-based online service designed to autonomously provide proof of skill and compliance documentation. The platform enables Vocational Education and Training (VET) organisations and related entities to demonstrate compliance requirements necessary to support funding eligibility for the provision of training services.
Services may include, but are not limited to:
- Digital capture, verification, and storage of skills evidence
- Automated compliance documentation generation
- Reporting and record management functionality
- Platform access and related technical support
CARDA does not guarantee the approval of funding applications, regulatory approvals, or compliance determinations by any external authority. Responsibility for final submission, interpretation, and regulatory compliance remains with the Client.
3. Subscription and Payment Policy
3.1 Subscription Model
CARDA is provided on a subscription basis. Subscriptions may be billed:
- Monthly (in advance), or
- Yearly (in advance)
Subscription periods automatically renew unless cancelled in accordance with these Terms.
3.2 Deposit
No deposit is required.
3.3 Payment Timing
Payment is due in advance of the applicable subscription period. Access to CARDA services is conditional upon receipt of payment.
Because CARDA operates as an ongoing subscription service rather than a fixed-scope project, services commence upon activation of the subscription and continue for the duration of the paid subscription period.
3.4 Billing and Payment Methods
Billing is processed via Xero.
Payment may be made by:
- Direct debit to a Commonwealth Bank of Australia (CBA) account; or
- Credit card via eWAY secure payment gateway.
By providing payment details, you authorise CARDA to debit the applicable subscription fees on the agreed billing cycle.
If a payment fails or is declined, CARDA may suspend access to the platform until payment is successfully processed.
4. Refund and Cancellation Policy
4.1 Cancellation by the Client
You may cancel your subscription at any time by providing written notice via email to people@2earth.net.
- Cancellation will take effect at the end of the current billing period.
- No partial refunds are provided for unused portions of a monthly or annual subscription, except where required by Australian Consumer Law.
- Access to CARDA will cease at the end of the paid subscription period.
4.2 Dissatisfaction with Services
If you are unhappy with the services provided, you must notify us in writing with details of your concerns.
We will:
- Review the issue promptly;
- Work with you in good faith to resolve technical or service-related concerns; and
- Where appropriate, provide remedial support or platform adjustments within the scope of the service.
Refunds will not be provided solely on the basis of dissatisfaction where services have been delivered as described, except as required under Australian Consumer Law.
4.3 Inability to Provide Service
If CARDA is unable to provide the service through no fault of the Client (for example, extended system failure or discontinuation of the platform):
- We may suspend or terminate the subscription; and
- We will provide a pro-rata refund for any prepaid subscription period during which the service is unavailable, unless the interruption is minor or temporary.
5. Limitation of Liability
To the extent permitted by law:
- CARDA provides the platform on an “as is” basis.
- We do not warrant that the service will be uninterrupted or error-free.
- We are not liable for indirect, incidental, or consequential loss, including loss of funding, revenue, or opportunity.
Nothing in these Terms excludes rights or remedies that cannot be excluded under the Australian Consumer Law.
6. Data and Compliance Responsibility
The Client is responsible for:
- Ensuring the accuracy and completeness of all data entered into CARDA;
- Maintaining compliance with applicable regulatory and funding requirements;
- Retaining independent professional or regulatory advice where necessary.
CARDA facilitates compliance documentation but does not replace regulatory advice or legal compliance obligations.
7. Amendments
We may update these Terms from time to time. Updated Terms will apply to renewed subscription periods and will be provided to Clients in writing or via platform notification.
8. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
By engaging CARDA and activating a subscription, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
